1Acceptance of Terms
By registering for a course, submitting an enrolment form, making a payment, attending any TrainingComplex training programme, or using our website, you confirm that:
- You are at least 18 years of age, or are enrolling with the consent of a parent or guardian.
- You have read, understood, and agree to be bound by these Terms in their entirety.
- Where you are enrolling on behalf of an organisation, you have authority to bind that organisation to these Terms.
If you do not accept these Terms, please do not enrol in or use our services.
2Our Services
TrainingComplex provides professional development and capacity-building services, including:
- Short courses and certificate programmes delivered in-person, online, or in hybrid format.
- Corporate and organisational training packages tailored to client needs.
- "Fly Me a Trainer" on-site delivery at a client's premises within Kenya and across Africa.
- Scheduled public training cohorts in Nairobi and other regional locations.
- An online learner portal for course materials, assignments, and progress tracking.
We reserve the right to modify, suspend, or discontinue any service, course, or feature at any time, with reasonable notice provided to enrolled participants.
Course descriptions, schedules, facilitators, and venues published on our website are indicative and subject to change. We will notify enrolled participants of any material changes as early as possible.
3Enrolment & Registration
Your enrolment is confirmed only upon receipt of full payment (or an approved purchase order for corporate clients) and an acknowledgement from TrainingComplex. An unpaid registration does not guarantee a seat.
3.1 Registration accuracy
You agree to provide accurate, current, and complete information when registering. TrainingComplex reserves the right to cancel an enrolment and withhold a certificate if false information is discovered.
3.2 Seat availability
All courses have limited seats. Seats are allocated on a first-come, first-paid basis. We recommend completing payment promptly after registering.
3.3 Substitutions
If you are unable to attend a confirmed booking, you may nominate a substitute participant of equivalent seniority from your organisation at no extra charge, provided you notify us in writing at least 5 business days before the course start date.
3.4 Minimum participant numbers
TrainingComplex reserves the right to cancel or reschedule a public training cohort if minimum enrolment numbers are not reached. Enrolled participants will be offered a full refund or transfer to an alternative date.
4Fees & Payment
All course fees are displayed on our website and booking confirmation. Unless stated otherwise, fees are quoted in Kenyan Shillings (KES) and include applicable taxes.
4.1 Accepted payment methods
- M-Pesa (Paybill or Till number provided on invoice).
- Bank transfer to TrainingComplex's designated account (details on invoice).
- Payment card (Visa/Mastercard) via our secure online gateway.
- Approved purchase orders for registered corporate clients (subject to a credit application).
4.2 Payment deadlines
Full payment must be received before or on the first day of training. For corporate purchase orders, payment is due within 30 days of the invoice date unless otherwise agreed in writing.
4.3 Late payment
Participants with outstanding balances may be denied access to training materials, the online portal, or their certificate until payment is settled. TrainingComplex reserves the right to charge interest on overdue corporate invoices at the prevailing Central Bank of Kenya rate plus 2% per annum.
4.4 Pricing changes
Fees quoted at the time of booking are honoured for that enrolment. Price changes for future cohorts will not affect confirmed bookings.
5Cancellation & Refund Policy
We understand plans change. Our refund policy is based on how far in advance you notify us before the course start date:

All cancellations must be submitted in writing to
info@thetrainingcomplex.com. Verbal cancellations are not accepted. The date of our written acknowledgement is the effective cancellation date.
5.1 Transfers
As an alternative to cancellation, you may transfer your enrolment to a future cohort of the same or equivalent course. Transfers are permitted once at no charge, provided the request is received at least 5 business days before the original course start date. Subsequent transfers may incur an administration fee.
5.2 TrainingComplex-initiated cancellations
If TrainingComplex cancels a course (e.g., due to insufficient enrolments or unforeseen circumstances), enrolled participants will receive a full refund or may elect to transfer to another cohort. We are not responsible for any travel, accommodation, or other costs incurred by participants.
5.3 Non-attendance
If you fail to attend a course without prior notice, the full fee is forfeited. No refund, transfer, or credit will be issued for a no-show.
6Certificates & Accreditation
Participants who meet all course requirements — including minimum attendance, assessed assignments, and payment in full — will be issued a TrainingComplex certificate of completion.
- Certificates are issued digitally (PDF) and/or in hard copy as specified for each course.
- Where a course is linked to an external accreditation body, the relevant body's certification requirements apply in addition to TrainingComplex's own requirements.
- TrainingComplex certificates are issued in the participant's registered name. Name correction requests due to registration errors will be accommodated free of charge within 30 days of issue.
- TrainingComplex does not guarantee employment outcomes, promotions, or professional licensing as a result of completing any course.
Attendance threshold: A minimum attendance of 80% of scheduled contact hours is required to qualify for a certificate. Participants who fall below this threshold due to absence (even with good reason) may be required to attend a future makeup session or re-enrol at a discounted rate.
7Intellectual Property
All training materials provided by TrainingComplex — including course notes, handouts, slide decks, videos, workbooks, case studies, and online content — are the exclusive intellectual property of TrainingComplex Institute or its licensors and are protected under Kenyan copyright law.
- Materials are licensed to enrolled participants for personal, non-commercial use only in connection with the course attended.
- You may not reproduce, distribute, sell, publish, broadcast, or adapt any course materials without prior written consent from TrainingComplex.
- Recording (audio or video) of training sessions is not permitted without the explicit written approval of TrainingComplex and the facilitator.
- Uploading TrainingComplex materials to third-party platforms, social networks, or file-sharing sites is strictly prohibited.
Breach of this clause may result in immediate termination of access and legal action to recover damages.
8Participant Code of Conduct
TrainingComplex is committed to providing a safe, inclusive, and productive learning environment for all participants. By enrolling, you agree to:
- Treat fellow participants, facilitators, and TrainingComplex staff with respect and professionalism at all times.
- Arrive on time and participate actively in all scheduled sessions.
- Refrain from any discriminatory, harassing, or threatening behaviour based on race, gender, religion, nationality, disability, age, or any other characteristic.
- Not engage in any conduct that disrupts the learning environment or undermines others' experience.
- Not plagiarise assignments, impersonate another participant, or engage in academic dishonesty.
- Comply with venue rules and health and safety requirements where applicable.
Breach of the Code of Conduct may result in removal from the training programme without a refund, and may be reported to your employer or relevant professional body where appropriate.
9Online Learning Platform
Where a course involves access to TrainingComplex's online learning portal, the following additional terms apply:
- Each participant is issued individual login credentials. You must not share your credentials with any other person.
- TrainingComplex cannot guarantee uninterrupted access to the platform and will not be liable for downtime caused by scheduled maintenance, third-party hosting issues, or circumstances beyond our control.
- Online course access is granted for the duration of the course plus a 30-day post-course review period unless otherwise specified. Access may be extended at TrainingComplex's discretion.
- You are responsible for ensuring you have a suitable device and stable internet connection. TrainingComplex does not provide technical support for personal devices or internet service providers.
- Any attempt to hack, disrupt, or interfere with the platform will result in immediate suspension and may be subject to criminal prosecution under Kenya's Computer Misuse and Cybercrimes Act, 2018.
10Corporate Training Agreements
Where TrainingComplex enters into a corporate training engagement with an organisation, the following provisions apply in addition to these general Terms:
- A separate written Scope of Work or Training Agreement will be executed, setting out specific deliverables, timelines, participant numbers, and agreed fees.
- The corporate client is responsible for ensuring that nominated participants meet any prerequisite requirements and comply with this Code of Conduct.
- Confidential information shared by either party in the course of a corporate engagement will be treated as strictly confidential and not disclosed to third parties without consent.
- Customised training materials developed specifically for a corporate client remain the intellectual property of TrainingComplex unless a written IP assignment is agreed and paid for.
- In the event of a conflict between these Terms and a signed corporate Training Agreement, the terms of the signed Agreement will prevail.
11Limitation of Liability
To the fullest extent permitted by Kenyan law, TrainingComplex's total liability to you for any claim arising out of or in connection with these Terms or the services provided shall not exceed the fees paid by you for the specific course to which the claim relates.
TrainingComplex is not liable for:
- Any loss of profit, business, revenue, or data, whether direct or indirect.
- Consequential, incidental, or special damages of any kind.
- Travel, accommodation, or subsistence costs incurred by participants in connection with any cancelled or rescheduled training.
- The actions or omissions of third-party facilitators, accreditation bodies, or venue providers.
- Failure to perform obligations where such failure is caused by events beyond our reasonable control (force majeure), including acts of God, strikes, government restrictions, pandemics, or internet outages.
Nothing in these Terms limits TrainingComplex's liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
12Governing Law
These Terms are governed by and construed in accordance with the Laws of Kenya. Both parties submit to the exclusive jurisdiction of the Kenyan courts for resolution of any disputes, without prejudice to the dispute resolution process set out in Section 13.
Relevant legislation that applies to these Terms includes (without limitation):
- The Law of Contract Act (Cap. 23), Laws of Kenya.
- The Consumer Protection Act, 2012.
- The Kenya Data Protection Act, 2019.
- The Copyright Act (Cap. 130), Laws of Kenya.
- The Computer Misuse and Cybercrimes Act, 2018.
- The Technical and Vocational Education and Training (TVET) Act, 2013 (where applicable to accredited programmes).
13Dispute Resolution
We are committed to resolving disputes quickly, fairly, and amicably. If you have a complaint, please follow these steps:
- Step 1 — Direct contact: Email us at info@thetrainingcomplex.com describing your concern. We aim to acknowledge your complaint within 2 business days and provide a full response within 10 business days.
- Step 2 — Mediation: If the matter is not resolved through direct contact, either party may refer the dispute to a mutually agreed mediator, with costs shared equally. Mediation will be conducted in accordance with the Nairobi Centre for International Arbitration (NCIA) Mediation Rules.
- Step 3 — Arbitration: If mediation fails, disputes may be referred to binding arbitration under the NCIA Arbitration Rules. The seat of arbitration shall be Nairobi, Kenya. The arbitration shall be conducted in English.
- Step 4 — Litigation: Either party retains the right to seek urgent interlocutory relief from the High Court of Kenya where necessary to prevent irreparable harm.
14Amendments
TrainingComplex reserves the right to amend these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page.
- Post a notice on our website for a reasonable period prior to the change taking effect.
- For enrolled participants, notify by email where the change materially affects an existing booking.
Your continued use of our services or attendance at any training event after the updated Terms have been posted constitutes your acceptance of those changes. If you do not accept the amended Terms, you may cancel your enrolment subject to the refund policy in Section 5.
